I have WSS setup and the top-level site is not used - only a few people
have permissions on it and I would like to keep it that way.

However I have added some web parts (content editor, image, form, xml
etc) to the web part gallery in the Top-level WSS site.

As a user with permission to read the top-level site, and admin a
sub-site you are shown the list of web parts. However if the admin of
the sub-site does not have access to read the top-level site then the
web parts do not appear in the browse list.

This seems to be a logical consquence of this.

Are you expecting that people who don't have rights to do anything with web
parts can see them? It seems illogical as if they can see them they would
expect to be able to drag and drop them onto a page but they have no rights
to them ....

Or is there a question there I missed ?

You can give them reader access to just the web part gallery on the top
level site. That should get you where you want to go.

Site Settings -> Go to Site Administration -> Manage Web Part gallery ->
Modify settings and columns -> Change permissions for this gallery

Thank you very much! Seems so obvious now but I didn't notice that you
could change list permissions on web part gallery in top level site. I
have test it and this works! Thank you very much.
