I have noticed that individuals who have recorded personal IM conversations
with others share the personal conversation of IM with others publicly
irregardless of the other parties consent of such acts...My question is: is
this practice illegal and in violation of MSN Instant Messenger CoC or are
there any implications to copyright infringement?

Is it illegal to share the contents of a letter mailed via the postal
service to someone else?
(Given you are the recepient of the mail?)

I would call it - at best - a gray area that is unlikely to be defined
either way - ever. After all - you are assuming your un-encrypted IM
messages were intercepted on the pathway to the intended recepient anyway.

Consider /anything/ you send in IM or email the electronic equivalent of a
postcard. Assume the postcard will be posted on your bulletin board at
work/church/local grocery store, etc.

yes I understand that mail and/or any communications may in fact be
intercepted as such and found in the most clandestine of areas...however, am
I then to assume that Microsoft's CoC which includes the following (Microsoft
does not allow behavior or content related to illegal activities. You cannot
use MSN communication services to publish, post, distribute, or disseminate
defamatory, infringing, obscene, or other unlawful material or discussion.
This includes, but is not limited to, child pornography, bestiality incest,
illegal drugs, software piracy, and harassment. ) is not enforced to any
degree?
